This page outlines the Terms & Conditions on which Evolve Menswear supply the goods (“Goods”) listed on our website www.evolvemenswear.com (“Website”) to you the customer. Any and all information provided on this Website is subject to these Terms & Conditions.
Please read these Terms & Conditions carefully and make sure that you understand them before ordering any Goods from our Website. Please be aware that by ordering Goods, you agree to be bound by these Terms & Conditions. We recommend that you print a copy of this page for reference.
We update our Terms & Conditions from time to time, so please review this page regularly.
1.1 This Website is owned and operated by Evolve Menswear. Throughout the Website, the terms “we”, “us” and “our” refer to Evolve Menswear. Our company details (postal address, telephone number, company registration number and VAT number) are detailed in Point 10.
1.2 The content on this website is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws, and are provided solely for your personal, non-commercial use. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute any content from this website without the express written permission of Evolve Menswear.
2. Products and Pricing
2.1 Our Website contains a large number of Goods, and while we take every care to ensure that the product prices and product descriptions are accurate, errors may occur.
2.2 All prices shown on the Website are inclusive of VAT. We do not deduct VAT for international customers.
2.3 Payment for all Goods via the Website must be made by a credit or debit card. All credit and debit payments are subject to validation checks and authorisation by the card issuer. If the issuer of your credit or debit card refuses to authorise payment to us, we shall not be held liable for any delay to or non-delivery of your order.
2.4 We reserve the right to withdraw any product from the Website at any time without prior notification.
2.5 We reserve the right to amend the prices of products without prior notification.
2.6 We verify product prices as part of our dispatch processes. If the Goods’ actual price is less than the price stated, we will charge you the lower amount. If the Goods’ actual price is higher than the price stated, we may reject your order.
3. Before You Place an Order
3.1 Before you place an order through the Website, you confirm that:
a) you are legally capable of entering into a binding contract;
b) you are at least 18 years of age;
c) all details you provide to us for the purpose of purchasing Goods are correct;
d) the credit or debit card which you use is your own, and you have sufficient funds or credit to cover the cost of the Goods.
3.2 We reserve the right to validate your credit or debit card details before providing you with any goods. It is a crime to deliberately use false details to order goods. Anyone caught doing so may be prosecuted.
4. Placing an Order
4.1 After placing an order for Goods, you will receive an e-mail from us acknowledging that we have received your order. This does not act as confirmation of order acceptance.
4.2 We reserve the right not to accept an order. We will refuse any order which we reasonably suspect may be fraudulent or illegal.
4.3 All orders are subject to acceptance by us and product availability. You will receive a second email from us acknowledging that your order has been accepted and dispatched (Dispatch Confirmation). A tracking number may be provided where applicable.
4.4 The contract of sale between you and us will only be formed once we have emailed you the Dispatch Confirmation.
4.5 If certain products are out of stock, subject to a delay, or are at a higher price than when you placed your order, we will attempt to contact you using the email address or telephone number you provided when placing your order. If we do not receive a response from you, we will continue to process the remainder of your order. We will not supply an alternative product without your prior authorisation.
5. Cancelling an Order
5.1 You have the statutory right may cancel an order at any time within fourteen (14) days, beginning on the day after you received the Goods. This is also known as the cooling off period.
5.2 To cancel an order please contact us by post, email or telephone to inform us that you intend to return the Goods to us.
5.3 You must return the Goods to us within fourteen (14) days after the day of delivery. You will be responsible for bearing the cost of returning the Goods to us in line with our Returns Policy (see Point 7).
5.4 Your statutory rights are not affected by the Terms & Conditions of this Website.
6.1 Any times or dates stated for delivery on our Website and in our correspondence with you are estimates only. Where estimates are not provided, a delivery timeframe of up to thirty (30) days will be applicable.
6.2 We make all reasonable efforts to deliver goods within the times specified, but we do not accept liability for any failure to deliver within that time.
6.3 If the Goods you have ordered are not available for delivery within thirty (30) days of the date of order, we will contact you by email or telephone and offer a refund or suggest an alternative item.
6.4 Once your order has been received you must check the Goods and notify us if there is any discrepancy with your original order or damage to the Goods received. This should be done within the cooling off period.
6.5 Upon deliver the Goods will be deemed in your possession and will be your responsibility.
6.6 When placing an order with Evolve Menswear you are entering into a contract with our chosen courier company. Our choice of courier will vary depending on order size and delivery location.
6.7 We reserve the right to change our chosen courier company without prior notification.

7.1 To return Goods please contact us by post, email or telephone and return the Goods to inform us you are doing so. If you are cancelling an order, this must be done within fourteen (14) days after the day of delivery (see Point 5).
7.2 You will be responsible for bearing the cost of returning the Goods to us unless the Goods are damaged or defective, in which case Evolve Menswear, at its discretion, will either:
a) exchange the goods and refund you your reasonable costs of returning the Goods;
b) refund to you the price paid for the Goods, the original postage cost, and your reasonable costs of returning the Goods;
7.3 Any damaged or faulty goods must be accompanied by the returns slip provided and include a written explanation of the damage or fault.
7.4 While in your possession, you must take reasonable care of the Goods that you intend to return to us:
a) you must not wear or use any Goods that you intend to return to us;
b) all Goods must be returned to us in their original packaging with tags, labels and barcodes still attached;
7.5 We reserve the right to refuse goods which have been damaged by your negligence, improper care or that show any wear and tear.
7.6 On receipt of the Goods we will refund you any monies owed within fourteen (14) days after receiving the Goods. We will refund you using the same method of payment you originally used when purchasing the Goods.
8.1 While we endeavour to ensure the availability of the Website, and that transmissions will be error-free, this cannot be guaranteed.
8.2 Your access to the Website may also be occasionally interrupted to allow for repairs, maintenance, and/or the introduction of new goods and services. We will attempt to limit the frequency and duration of any such interruptions.
8.3 We will not be liable for any loss of data, lost profits, lost revenues, business interruption, loss of reputation or any other indirect or consequential loss arising from the use of this Website or goods / services purchased from this company.
8.4 Nothing in these conditions shall limit or exclude any lability that is not permitted to be limited or excluded by applicable law.
9. Customs and Import Duty
9.1 When ordering products from Evolve Menswear for delivery outside of the European Union (“EU”) they may be subject to import duties which may be levied once the Goods reach the destination country. Any additional charges for customs clearance must be borne by the recipient of the order.
9.2 Please be aware that cross-border deliveries are subject to inspection by customs authorities and may be opened.
9.3 Customs policies vary from country to country, so you should contact your local customs office for further information. Please note that when ordering from Evolve Menswear from outside of the EU, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products.
